What an EU Representative does

Acts as the formal local point of contact for EU supervisory authorities and data subjects. Receives and handles correspondence in the EU. Maintains a copy of the controller's Records of Processing Activities. Cooperates with supervisory authorities during investigations.

The EU Representative role is distinct from the Data Protection Officer role. Per EDPB guidance, these functions must be operationally separate even when delivered by the same provider, to avoid conflicts of interest.

Who needs an EU Representative

Any controller or processor outside the EU that offers goods or services to people in the EU, or monitors the behavior of people in the EU. Exceptions exist for occasional processing that is unlikely to result in risk, and for public authorities.

A common misconception is that having a sales office in the EU eliminates the need for an EU Representative. Sales presence does not satisfy the Article 27 requirement unless the EU entity is the actual controller or processor.
